These Terms of Service (“Terms”) govern your access to and use of the website located at safeairradontesting.com (the “Site”) and the radon testing and reporting services provided by SafeAir Radon Testing (“SafeAir,” “we,” “us,” or “our”). By using the Site, requesting a quote, scheduling an appointment, or engaging our services, you (“you,” “your,” or “Client”) agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.
1. About Our Services
SafeAir Radon Testing is an independent radon measurement and reporting company serving metro Atlanta and North Georgia. We have provided radon testing services since 2009.
Scope of services. Our services are limited to:
- Placing and operating certified radon measurement devices;
- Conducting residential, real estate, commercial, and post-mitigation radon tests;
- Producing certified written reports of measured radon concentrations (expressed in picocuries per liter, or pCi/L); and
- Providing a plain-language consultation explaining your results.
2. What We Do Not Do (Independence)
SafeAir does not sell, install, service, design, repair, or profit from radon mitigation systems, and we do not accept referral fees from any mitigation contractor. Our role is strictly that of an independent, neutral third party that measures and reports.
We do not diagnose mitigation systems, recommend specific repairs, or advise on contractor selection. Any general information we provide about mitigation options or independent referrals is offered solely as a courtesy and does not constitute an endorsement, recommendation, or warranty of any third party.
3. Scheduling, Access, and Appointments
When you schedule a test, you authorize SafeAir and its certified inspectors to access the property at the agreed date and time to place, retrieve, and operate measurement equipment. You represent that you have the legal right and authority to grant access to the property to be tested, or that you have obtained permission from the owner or authorized party.
Appointment times are estimates and may be affected by weather, scheduling, access conditions, or events beyond our control. We will make reasonable efforts to notify you of any changes.
4. Client Responsibilities and Test Conditions
Accurate radon measurement depends on proper test conditions. You agree to:
- Maintain required test conditions. For most residential and post-mitigation tests, this includes “closed-house conditions” — keeping windows and exterior doors closed (except for normal entry and exit) for at least 12 hours before and throughout the test period, per EPA protocol. Written instructions will be provided before the test. For real estate transactions, maintaining closed-house conditions is typically the responsibility of the seller or listing agent.
- Not disturb, move, cover, or tamper with the measurement device during the test period.
- Maintain normal operating conditions as instructed for the applicable test type (for example, commercial tests are conducted under normal building operating conditions rather than sealed residential conditions).
- Disclose any known conditions that could affect testing or inspector safety.
SafeAir is not responsible for inaccurate, invalid, or compromised results caused by failure to maintain required test conditions, tampering with equipment, or interference with the test environment. If test conditions are not met, a re-test may be required, which may be subject to an additional fee.
5. Reports and Results
Reports reflect the radon concentration measured at a specific location, over a specific time period, under the conditions present during the test. Radon levels naturally fluctuate over time and can vary by season, weather, occupancy, and building changes. A test result is a snapshot and does not guarantee future radon levels.
Reports are provided for informational purposes and are based on EPA-recognized measurement methods. The U.S. EPA action level is 4.0 pCi/L. We report your measured value and explain how it compares to recognized reference levels, but we do not determine, certify, or guarantee that a property is “safe” or “unsafe.” Decisions based on a report are yours alone.
6. No Professional, Legal, Medical, or Real Estate Advice
Information provided by SafeAir, including reports, consultations, and Site content, is for general informational purposes only and is not legal, medical, financial, engineering, or real estate advice. Radon health information referenced from the EPA, CDC, U.S. Surgeon General, and other authorities is summarized for convenience and is not a substitute for professional advice. You should consult appropriate licensed professionals regarding decisions affecting health, real estate transactions, or legal matters.
7. Real Estate Transactions
When a test is performed in connection with a real estate transaction, SafeAir provides an independent measurement and written report only. We are not a party to the transaction and take no role in negotiations, disclosures, contingencies, financing, or closing decisions. Interpretation of results, negotiation of remedies, and any contractual obligations among buyers, sellers, agents, attorneys, and lenders are solely the responsibility of those parties.
8. Fees and Payment
Fees for services are as quoted at the time of scheduling. Payment is due as agreed when you book, and accepted payment methods will be communicated at that time. Quoted fees cover only the testing and reporting services described.
9. Cancellation and Rescheduling
If you need to cancel or reschedule, please notify us as far in advance as possible before your appointment. Cancellations or missed appointments without reasonable notice, or trips where the inspector cannot access the property, may be subject to a fee. Re-tests required due to invalid test conditions under Section 4 may also be subject to an additional charge.
10. Disclaimer of Warranties
THE SITE AND OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” EXCEPT AS EXPRESSLY STATED, SAFEAIR MAKES NO WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We perform testing using EPA-recognized methods and certified equipment and warrant only that services will be performed in a professional and workmanlike manner consistent with applicable measurement standards. We do not warrant that results will be uninterrupted, error-free, or that any particular outcome will result from testing.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SAFEAIR AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITY, OR DIMINISHED PROPERTY VALUE, ARISING OUT OF OR RELATED TO OUR SERVICES, REPORTS, OR THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, SAFEAIR’S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO SAFEAIR FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
Because radon levels vary naturally over time, a measurement reflects conditions during the test period only and is not a guarantee of future levels or of health outcomes.
12. Indemnification
You agree to indemnify and hold harmless SafeAir and its owners, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misrepresentation of authority to permit testing, your failure to maintain required test conditions, or your use or distribution of any report.
13. Intellectual Property
All content on the Site — including text, graphics, logos, and reports — is the property of SafeAir or its licensors and is protected by applicable intellectual property laws. Reports are provided for your use in connection with the property tested. You may share a report with relevant parties to a transaction (such as agents, attorneys, lenders, or title companies), but you may not alter, excerpt in a misleading way, or misrepresent a report.
14. Third-Party Links and References
The Site may reference or link to third-party websites, agencies, or resources. These are provided for convenience only. SafeAir does not control and is not responsible for the content, accuracy, or practices of any third party.
15. Privacy
Your use of the Site and our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Information you submit through our forms is used to provide services and is not sold or shared except as described in the Privacy Policy.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or our services shall be brought exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to the jurisdiction of those courts.
17. Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date above reflects the most recent revision. Continued use of the Site or our services after changes are posted constitutes acceptance of the revised Terms.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
